The minimum technical requirements enabling the use of the Online Store Website are a web browser in a version of at least Microsoft Edge 109 or Internet Explorer 11 or Chrome 110 or FireFox 109 or Opera 95 or Safari 11 or newer, with JavaScript enabled, accepting "cookies" files, and an internet connection with a bandwidth of at least 256 kbit/s. The purpose of using "cookies" is the correct operation of the Online Store Website on the Customers' end devices. This mechanism does not damage the Customer's end device and does not cause configuration changes in the Customers' end devices or in the software installed on those devices. Each Customer may disable the "cookies" mechanism in the web browser of his or her end device. The Seller points out, however, that disabling "cookies" may make it difficult or impossible to use the Online Store Website.

After completing the entire order and indicating in the “CART” the method of Delivery and the form of payment, the Customer places the order by sending the order form to the Seller, selecting the “Order with obligation to pay” button on the Online Store Website. Each time before the order is sent to the Seller, the Customer is informed of the total price for the selected Goods and Delivery, as well as of all additional costs that the Customer is obliged to bear in connection with the Sales Agreement.

2. The Customer may choose the following forms of payment for the ordered Goods:
a) bank transfer to the Seller's bank account (in this case, processing of the order will begin after the Seller has sent the Customer confirmation of acceptance of the order and after the funds have been credited to the Seller's bank account);
b) cash on delivery, payment to the Carrier upon Delivery (in this case, processing of the order will begin after the Seller has sent the Customer confirmation of acceptance of the order).
3. The Customer should pay for the order in the amount resulting from the concluded Sales Agreement within 7 Business Days, if they have chosen the prepayment option.
4. If the Customer fails to make payment within the period referred to in §5 para. 3 of the Terms and Conditions, the Seller sets the Customer an additional period for payment and informs the Customer of it on a Durable Medium. The information on the additional payment period also states that, after this period expires without payment, the Seller will withdraw from the Sales Agreement. If the second payment period expires without payment, the Seller will send the Customer, on a Durable Medium, a declaration of withdrawal from the contract pursuant to Article 491 of the Civil Code (Kodeks cywilny).
§ 6 Delivery
1. The Seller carries out Delivery within the territory of the Republic of Poland.
2. The Seller is obliged to deliver Goods that conform to the Sales Agreement.
3. The Seller publishes on the Online Store Website information on the number of Business Days needed for Delivery and for processing the order.
4. The Delivery and order processing time indicated on the Online Store Website is calculated in Business Days in accordance with §5 para. 2 of the Terms and Conditions.
5. The ordered Goods are delivered to the Customer by the Carrier to the address indicated in the order form.
6. On the day the Goods are dispatched to the Customer, information confirming dispatch of the consignment by the Seller is sent to the Customer's e-mail address.
7. The Customer is obliged to examine the delivered consignment within the time and in the manner customary for consignments of the given type. If loss of or damage to the consignment is found, the Customer has the right to demand that the Carrier's employee draw up an appropriate report.
8. The Seller, in accordance with the Customer's wishes, encloses with the consignment that is the subject of Delivery a receipt or a VAT invoice covering the delivered Goods.
In order to receive a VAT invoice, the Customer should declare at the time of purchase that they are purchasing the Goods as an Entrepreneur (taxpayer). This declaration is made by ticking the appropriate field in the order form, before the order is sent to the Seller.
9. If the Customer is absent from the address indicated by them and given when placing the order as the Delivery address, the Carrier's employee will leave a delivery notice or attempt to contact the Customer by telephone in order to agree a time at which the Customer will be present. If the ordered Goods are returned to the Online Store by the Carrier, the Seller will contact the Customer by electronic means or by telephone, agreeing with the Customer again the date and cost of Delivery.
10. The default form of issuing invoices is structured invoices (“fakturyustrukturyzowane”) issued and made available using the National e-Invoicing System (“Krajowy System e-Faktur”) within the meaning of the Act of 11 March 2004 on Goods and Services Tax (ustawa o podatku od towarów i usług).
§ 7 Statutory Warranty (rękojmia) for Entrepreneurs
1. The Seller ensures Delivery of Goods free from defects. The Seller is liable to the Entrepreneur if the Goods have a defect.
2. If the Goods have a defect, the Entrepreneur may:
a) submit a declaration of price reduction or of withdrawal from the Sales Agreement, unless the Seller promptly and without undue inconvenience to the Entrepreneur replaces the defective Goods with defect-free ones or remedies the defect.
This limitation does not apply if the Goods have already been replaced or repaired by the Seller, or if the Seller has failed to fulfil the obligation to replace the Goods with defect-free ones or to remedy the defects. Instead of the remedy of the defect proposed by the Seller, the Entrepreneur may demand replacement of the Goods with defect-free ones, or instead of replacement of the Goods may demand remedy of the defect, unless bringing the item into conformity with the contract in the manner chosen by the Entrepreneur is impossible or would require excessive costs compared with the manner proposed by the Seller. In assessing whether costs are excessive, the value of the defect-free Goods, the type and significance of the defect found are taken into account, as well as the inconvenience to which the Entrepreneur would be exposed by another method of satisfaction.
The Entrepreneur may not withdraw from the Sales Agreement if the defect is insignificant.
b) demand replacement of the defective Goods with defect-free ones or remedy of the defect. The Seller is obliged to replace the defective Goods with defect-free ones or to remedy the defect within a reasonable time without undue inconvenience to the Entrepreneur.
The Seller may refuse to comply with the Entrepreneur's demand if bringing the defective Goods into conformity with the Sales Agreement in the manner chosen by the Entrepreneur is impossible or, compared with the other possible way of bringing it into conformity with the Sales Agreement, would require excessive costs. The costs of repair or replacement are borne by the Seller.
3. The Seller is liable under the statutory warranty (rękojmia) if a physical defect is found before two years have elapsed from the handing over of the Goods to the Entrepreneur. A claim for remedy of the defect or for replacement of the Goods with defect-free ones becomes time-barred after one year, but this period may not end before the expiry of the period specified in the first sentence. Within this period the Entrepreneur may withdraw from the Sales Agreement or submit a declaration of price reduction because of the defect in the Goods. If the Entrepreneur demanded replacement of the Goods with defect-free ones or remedy of the defect, the period for withdrawal from the Sales Agreement or for submitting a declaration of price reduction begins upon the unsuccessful expiry of the period for replacing the Goods or remedying the defect
4. An Entrepreneur exercising rights under the statutory warranty (rękojmia) is obliged to deliver the defective item to the Seller's address. The cost of delivery shall be borne by the Seller.
5. Any complaints relating to the Goods or the performance of the Sales Agreement may be submitted by the Entrepreneur in writing to the Seller's address
6. Within 14 days of the date of the request containing the complaint, the Seller shall respond to the complaint regarding the Goods or the complaint relating to the performance of the Sales Agreement submitted by the Entrepreneur.
§ 8 Non-conformity of the Goods with the Contract
Complaint by a Consumer and by an Entrepreneur with Consumer rights
1. The Goods are in conformity with the contract if, in particular, their following features are in conformity with the contract:
a) description, type, quantity, quality, completeness and functionality, and, in the case of goods with digital elements, also compatibility, interoperability and availability of updates;
b) suitability for a particular purpose for which it is required by the Consumer or the Entrepreneur with Consumer rights, of which the Consumer or the Entrepreneur with Consumer rights notified the Seller at the latest at the time of conclusion of the contract and which the Seller accepted.
2. In addition, in order to be considered in conformity with the contract, the Goods must:
a) be fit for the purposes for which Goods of that type are normally used, taking into account applicable legal provisions, technical standards or good practices;
b) be present in such quantity and have such characteristics, including Durability and safety, and, in the case of Goods with digital elements, also functionality and compatibility, as are typical for Goods of that type and which the Consumer or the Entrepreneur with Consumer rights may reasonably expect, taking into account the nature of the Goods and any public statement made by the Seller, its legal predecessors or persons acting on their behalf, in particular in advertising or on the label, unless the Seller proves that:
a. he was not aware of the given public statement and, reasonably assessed, could not have been aware of it;
b. before the conclusion of the contract, the public statement was corrected, under the conditions and in the form in which the public statement was made, or in a comparable manner;
c. the public statement had no influence on the decision of the Consumer or the Entrepreneur with Consumer rights to conclude the contract.
c) be delivered with the packaging, accessories and instructions which the Consumer or the Entrepreneur with Consumer rights may reasonably expect to receive;
d) be of the same quality as a sample or model which the Seller made available to the Consumer or the Entrepreneur with Consumer rights before the conclusion of the contract, and correspond to the description of such sample or model.
3. The Seller shall not be liable for the lack of conformity of the Goods with the contract to the extent referred to in §8 para. 2, if the Consumer or the Entrepreneur with Consumer rights, at the latest at the time of conclusion of the contract, was expressly informed that a particular feature of the Goods deviates from the requirements for conformity with the contract set out in §8 para. 2, and expressly and separately accepted the lack of that particular feature of the Goods.
4. The Seller shall be liable for the lack of conformity of the Goods with the contract resulting from improper installation of the Goods, if:
a) it was carried out by the Seller or under the Seller's responsibility;
b) improper installation carried out by the Consumer or the Entrepreneur with Consumer rights resulted from errors in the instructions provided by an entrepreneur or a third party.
5. The Seller shall be liable for the lack of conformity of the Goods with the contract existing at the time of their delivery and revealed within two years from that time, unless the period of fitness of the Goods for use, specified by the Seller, its legal predecessors or persons acting on their behalf, is longer. It is presumed that a lack of conformity of the Goods with the contract which became apparent before the lapse of two years from the time of delivery of the Goods existed at the time of their delivery, unless proven otherwise or unless this presumption cannot be reconciled with the nature of the Goods or the nature of the lack of conformity of the Goods with the contract.
6. The Seller may not rely on the expiry of the period for establishing the lack of conformity of the Goods with the contract, specified in §8 para. 5, if it fraudulently concealed that lack of conformity.
7. If the Goods are not in conformity with the contract, the Consumer or the Entrepreneur with Consumer rights may demand their repair or replacement.
8. The Seller may replace the Goods when the Consumer or the Entrepreneur with Consumer rights demands repair, or the Seller may repair the Goods when the Consumer or the Entrepreneur with Consumer rights demands replacement, if bringing the Goods into conformity with the contract in the manner chosen by the Consumer or the Entrepreneur with Consumer rights is impossible or would involve excessive costs for the Seller. If repair and replacement are impossible or would involve excessive costs for the Seller, the Seller may refuse to bring the Goods into conformity with the contract.
9. When assessing whether the costs for the Seller are excessive, all circumstances of the case shall be taken into account, in particular the significance of the lack of conformity of the Goods with the contract, the value of the Goods if they were in conformity with the contract, and the excessive inconvenience to the Consumer or the Entrepreneur with Consumer rights resulting from a change in the manner of bringing the Goods into conformity with the contract.
10. The Seller shall carry out the repair or replacement within a reasonable time from the moment at which the Seller was informed by the Consumer or the Entrepreneur with Consumer rights of the lack of conformity with the contract, and without excessive inconvenience to the Consumer or the Entrepreneur with Consumer rights, taking into account the nature of the Goods and the purpose for which the Consumer or the Entrepreneur with Consumer rights acquired them. The costs of repair or replacement, including in particular the costs of postage, transport, labour and materials, shall be borne by the Seller.
11. The Consumer or the Entrepreneur with Consumer rights shall make the Goods subject to repair or replacement available to the Seller. The Seller shall collect the Goods from the Consumer or the Entrepreneur with Consumer rights at the Seller's own expense.
12. If the Goods were installed before the lack of conformity of the Goods with the contract became apparent, the Seller shall dismantle the Goods and reinstall them after the repair or replacement has been carried out, or shall commission these activities at the Seller's own expense.
13. The Consumer or the Entrepreneur with Consumer rights is not obliged to pay for the normal use of the Goods which have subsequently been replaced.
14. If the Goods are not in conformity with the contract, the Consumer or the Entrepreneur with Consumer rights may submit a statement on a price reduction or on withdrawal from the contract, where:
a) the Seller refused to bring the Goods into conformity with the contract in accordance with §8 para. 8 above;
b) the Seller failed to bring the Goods into conformity with the contract in accordance with §8 para. 10 to §8 para. 12 above;
c) the lack of conformity of the Goods with the contract persists, despite the Seller having attempted to bring the Goods into conformity with the contract;
d) the lack of conformity of the Goods with the contract is so significant that it justifies a price reduction or withdrawal from the contract without first making use of the remedies set out in §8 para. 7 to §8 para. 12 above;
e) it is clear from the Seller's statement or from the circumstances that the Seller will not bring the Goods into conformity with the contract within a reasonable time or without excessive inconvenience to the Consumer or the Entrepreneur with Consumer rights.
15. The Seller is obliged to respond to the consumer's complaint within 14 days of its receipt.
16. The Seller shall refund to the Consumer or the Entrepreneur with Consumer rights the amounts due as a result of exercising the right to a price reduction without delay, and no later than within 14 days of receipt of the statement of the Consumer or the Entrepreneur with Consumer rights on the price reduction.
17. The Consumer or the Entrepreneur with Consumer rights may not withdraw from the contract if the lack of conformity of the Goods with the contract is insignificant. It is presumed that the lack of conformity of the Goods with the contract is significant.
18. If the lack of conformity with the contract concerns only some of the Goods delivered under the contract, the Consumer or the Entrepreneur with Consumer rights may withdraw from the contract only in respect of those Goods, and also in respect of other Goods acquired by the Consumer or the Entrepreneur with Consumer rights together with the Goods not in conformity with the contract, if the Consumer or the Entrepreneur with Consumer rights cannot reasonably be expected to agree to keep only the Goods in conformity with the contract.
19. In the event of withdrawal from the contract, the Consumer or the Entrepreneur with Consumer rights shall return the Goods to the Seller without undue delay, at the Consumer's or Entrepreneur's expense. The Seller shall refund the price to the Consumer or the Entrepreneur with Consumer rights without undue delay, no later than within 14 days of receiving the Goods or proof of their return.
20. The Seller shall refund the price using the same method of payment as that used by the Consumer or the Entrepreneur with Consumer rights, unless the Consumer or the Entrepreneur with Consumer rights has expressly agreed to a different method of refund that does not involve any costs for them.
21. The Seller does not use the out-of-court dispute resolution referred to in the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Ustawa o pozasądowym rozwiązywaniu sporów konsumenckich).
§ 9 Warranty
1. Goods sold by the Seller may be covered by a warranty granted by the manufacturer or distributor of the Goods.
2. In the case of Goods covered by a warranty, information on the existence and content of the warranty is presented in each case on the Online Store website.
§ 10 Withdrawal from the Sales Agreement
1. A Customer who is a Consumer and an Entrepreneur with Consumer rights who has concluded a Sales Agreement may withdraw from it within 14 days without giving any reason.
2. The period for withdrawal from the Sales Agreement begins when the Goods come into the possession of the Consumer, the Entrepreneur with Consumer rights, or a third party designated by them other than the carrier.
The Consumer and the Entrepreneur with Consumer rights may withdraw from the Sales Agreement by submitting a statement of withdrawal to the Seller. This statement may be submitted, for example, in writing to the Seller's address, i.e.: QUEEN OF FASHION HAIR ŁUKASZ KEMPSKI, ul. Bratków 7 (42-310), Żarki, or by electronic mail to the Seller's address, i.e.: biuro@queenfh.com. To meet the deadline, it is sufficient to send the statement before it expires.
The Consumer and the Entrepreneur with Consumer rights may withdraw from the Sales Agreement by submitting a statement of withdrawal to the Seller via the form made available on the website at: Electronic withdrawal form. 3. The Consumer and the Entrepreneur with Consumer rights may withdraw from the Sales Agreement by using the button placed on the Online Store website named: “Withdraw from the contract here”. The Customer completes the form available on the website, providing the necessary data, and confirms withdrawal from the Sales Agreement by clicking the button “Confirm withdrawal from the contract”. The Seller shall promptly confirm receipt of the statement to the e-mail address provided by the Customer.
4. In the event of withdrawal from the Sales Agreement, it is deemed not to have been concluded.
5. If the Consumer or the Entrepreneur with Consumer rights submitted a statement of withdrawal from the Sales Agreement before the Seller accepted their offer, the offer ceases to be binding.
6. The Seller is obliged, without undue delay and no later than within 14 days of receiving the statement of the Consumer or the Entrepreneur with Consumer rights on withdrawal from the Sales Agreement, to refund to them all payments made by them, including the cost of Delivery of the Goods to the Consumer or the Entrepreneur with Consumer rights. The Seller may withhold the refund of payments received from the Consumer or the Entrepreneur with Consumer rights until the Goods have been received back or the Consumer or the Entrepreneur with Consumer rights has provided proof of return of the Goods, whichever event occurs first.
7. If the Consumer or the Entrepreneur with Consumer rights exercising the right of withdrawal has chosen a method of delivery of the Goods other than the cheapest standard method of Delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer or the Entrepreneur with Consumer rights for the additional costs incurred by them.
8. The Consumer or the Entrepreneur with Consumer rights is obliged to return the Goods to the Seller without undue delay, but no later than within 14 days of the day on which they withdrew from the Sales Agreement. To meet the deadline, it is sufficient to send the Goods back to the Seller's address before this period expires.
9. In the event of withdrawal, a Customer who is a Consumer or an Entrepreneur with Consumer rights bears only the direct costs of return.
10. If, due to its nature, the Goods cannot be returned by ordinary post, the Seller shall inform the Consumer and the Entrepreneur with Consumer rights of the costs of returning the item on the Online Store website.
11. The Consumer and the Entrepreneur with Consumer rights are liable for any diminished value of the Goods resulting from handling them in a manner beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
12. The Seller shall refund payments using the same method of payment as that used by the Consumer or the Entrepreneur with Consumer rights, unless the Consumer or the Entrepreneur with Consumer rights has expressly agreed to a different method of refund that does not involve any costs for them.
13. The right of withdrawal from the Sales Agreement does not apply to the Consumer and the Entrepreneur with Consumer rights in respect of contracts in which the Goods are an item delivered in a sealed package which cannot be returned after opening for reasons of health protection or hygiene, if the package has been opened after delivery.
